Laws and regulations surrounding claims for compensation on whiplash injuries vary from country to country, and possibly even state to state in the USA. You would be best off consulting an accident and injury lawyer in the first instance to decide whether or not you have a case for compensation.

In the UK, an interesting legal situation arises where some lawyers claim that you will not pay a penny if they win your case, nor if you lose. Obviously this sounds too good to be true, and please check the small print, but be aware that UK law has a provision for these firms to claim fees from the government for actions taken on behalf of the client! So basically, the taxpayer pays your claim for you!

Typically the following compensation schedules apply in the UK to claims on "minor" whiplash injuries:
  • Make a recovery within 1 year - £750 - £2,500.
  • Make a recovery within 2 years - £2,500 - £4,250.
For moderate injuries and "severe" cases, the following schedule loosely applies:
  • Moderate cases - £4,250 - £7,750 .
  • Severe cases - £7,750 - £13,750.
